How does a salary account get frozen?

You use your account mainly to receive your monthly salary. Then one day, a transfer you did not expect lands in it.

Someone may have sent money to you by mistake. A buyer’s payment for something you sold online may have been flagged. Or someone you know may have asked to pass money through your account, which you should never agree to.

That one transaction can pull your whole account into an investigation. [f1] Under AMLA Section 44, the authorities can freeze an account when any transaction is suspected of being linked to crime. The freeze covers the whole account, including your salary.

The bank does not separate your salary from the suspicious transfer. Once the freeze order is issued, everything is locked, and on payday you cannot touch your wages.

What happens straight away?

For a nurse, a frozen salary account causes a chain of problems, because your monthly pay is what you live on.

Rent or mortgage payments bounce. Car loan instalments are missed. Credit card bills go unpaid.

Your employer must still pay your wages on time under the Employment Act. [f3] Section 19 requires wages within seven days after the wage period ends, and breaches can lead to a fine of up to RM50,000 under the general penalty in Section 99A. The freeze is not your employer’s fault. If you already have another account in your own name, HR may agree to pay into it.

Money stress on top of hospital or clinic shifts is hard. But there are clear legal steps to ask for your salary to be released while the investigation goes on.

How do your nursing records help?

As a registered nurse, you have a documented work history. [f4] Your Malaysian Nursing Board registration shows you hold a professional licence, and your employment letter confirms your job and salary.

Your pay slips show a steady monthly income that matches the salary credits in your bank statements. That steady pattern can make it easier to separate your salary from the one transfer that caused the freeze.

Gather your nursing board registration card, employment letter, recent pay slips and the last 12 months of bank statements. Our source-of-funds guide shows how to put them into a clear evidence file.

How do you get your salary released?

Under AMLA Section 44A, you can ask the enforcement agency that froze the account, in writing, to vary the freeze so your salary is released for essential costs. [f2] This application is about your living costs, not about proving your innocence. You show that your salary is genuine and that you need it to live.

For an AMLA s44 freeze, it is a written application to the agency that issued the freeze, and a more senior officer decides. If the police froze the account under CPC s116D, you apply to the Sessions Court instead.

Your lawyer prepares the application with your employment letter, pay slips, loan letters and a list of monthly costs. Clear employment records may help.

While you wait, ask HR whether they can pay your salary into another account you already hold in your own name. Read more about frozen salary accounts.

Can you complain to Bank Negara?

If the freeze came from the bank’s own review rather than a police order, you can complain to Bank Negara Malaysia. [f5] BNM has a channel for people who think a bank froze their account wrongly.

Whether it is a police freeze or a bank’s own hold makes a big difference. A police or agency freeze is varied through the steps above. A bank’s own hold may be lifted by the bank once you give a good explanation and papers.

Your lawyer can work out which type you face and choose the right route. Know your rights as an account holder.

What should you do right now?

Contact HR. Tell them your account is frozen. If you already have another account in your own name, ask whether they can pay your next salary into it.

Gather your work documents. Nursing board registration, employment letter, pay slips and your bank statements for the past 12 months. These are your main evidence.

Find the suspicious transaction. Go through your recent bank activity for the transfer that may have caused the freeze. Note the date, amount and sender if shown.

Try to speak to a lawyer before the police interview. A lawyer can help you explain what happened accurately. Your first steps after finding the freeze can affect how it is resolved.

Remember what a freeze is. A frozen account is stressful, but it is not a criminal charge.

Why is my salary account frozen when I did nothing wrong?

One suspicious transaction can freeze the account, even if you did not make it. Someone may have sent money to you by mistake, or your account may have been linked to suspicious activity. A freeze is not a finding that you did anything wrong.

Can my employer pay my salary into a different account?

If you already have another account in your own name, ask HR to pay your salary into it. Your employer must still pay you on time under the Employment Act. Do not open a new account to move frozen money, and never use someone else's account.

How quickly can I get my salary released?

No one can promise a date. For an AMLA s44 freeze, you apply in writing to the agency that issued it to vary the freeze, and a more senior officer decides. A ready application showing your salary, loans and living costs may help. Start preparing early.

Will this affect my nursing licence?

A bank freeze is not a charge. The Malaysian Nursing Board deals with professional misconduct, and a criminal charge could raise that question. If you are worried about your registration, ask a lawyer.

Should I explain the suspicious transfer to the police?

Cooperate with the police, but get a lawyer to help you prepare your account of what happened. Your explanation, backed by your employment and bank records, is what can help clear the matter.
