Why a growing startup can trigger a freeze

Your customer base grew, more people started paying you, and the money in your account changed quickly. To an automated monitoring system, that can look the same as money passing through a mule account. [f1]

Two very different things can happen next. Your bank’s compliance team can place a hold under its anti-money-laundering duties. Or, if the case goes to investigators, an authority can issue a real freeze under the Anti-Money Laundering Act, AMLA 2001. [f2]

Both stop your business from moving money. But they are separate processes, and which one you face decides what you do next.

Ask your bank in writing who imposed the restriction. It may be the bank’s own compliance measure, or an order from the police or the Public Prosecutor at the Attorney General’s Chambers.

A bank hold may have no outside case number. A police or AMLA freeze names the authority that issued it and carries a reference number for a real investigation.

This decides your next step. A bank hold is settled through the bank’s own complaint process. A legal freeze is settled through the legal process, including an application to release funds if you need them.

If the bank placed the hold

Ask in writing for the exact reason and for the documents the bank needs to lift the hold. The bank may ask for invoices, customer contracts and an explanation of your growth.

If the bank is slow or does not reply, you can complain through BNMLINK at 1-300-88-5465 or the BNMLINK portal. [f6] This is BNM’s official channel for complaints about how a bank handled your account. It is separate from any legal freeze order.

If it is a police or AMLA freeze

For a freeze under AMLA section 44, section 44A lets you apply in writing to the agency for money for payroll, rent and other essential costs. [f3]

A more senior officer decides, with no court involved. For a startup with little runway, this is the first job.

The freeze also has time limits. A section 44 freeze ends after 90 days unless you are charged, and under section 52A a later seizure or section 50 order lapses after 18 months if no one is charged. [f4] Strong company documents may help it end sooner.

If the case becomes a criminal investigation, it usually moves to CCID, PDRM’s Commercial Crime Investigation Department. [f5] Handing over your incorporation papers, financial statements and customer records early can help it move.

Protecting payroll and runway during the freeze

List what you must pay soon: payroll dates, rent, supplier invoices and loan repayments. This list becomes the basis of the application to release funds and shows what is at stake.

Tell your team early, in general terms, without alarming them. A plain, honest update goes down better than silence followed by a missed payday.

Do not move business money through a director’s personal account or someone else’s account to get around the freeze. It creates new problems and can make an innocent situation look like you are hiding something.

What to tell investors

Investors want three things: what happened, what you are doing about it, and a realistic timeline. A clear, factual update works better than avoiding the subject.

Bringing in a lawyer early, and telling investors you have, shows the matter is being handled properly.

How a lawyer moves this forward

A lawyer who handles mule account defence first confirms whether you face a bank hold or a legal freeze. Then they take the right route: a complaint through BNM channels, or a section 44A application and contact with the investigating officer. [f3]

That saves guessing which process applies, which matters when payroll and investor updates are due.

Is my account frozen by the bank or by the police?

It could be either, and the difference matters. A bank hold comes from the bank's own monitoring under its anti-money laundering duties, while a police or AMLA freeze comes from a law enforcement authority. [f1] Ask your bank in writing which one it is, because the next steps and paperwork differ.

Why would fast customer growth look suspicious to a bank?

Banks use automated systems that flag sudden jumps in volume, many new payers, or payments that do not match your account's history. A real startup signing up customers quickly can hit the same triggers as a mule account. [f2] The system sees the pattern, not your intent.

Can we get money for payroll while this is under review?

For an AMLA section 44 freeze, section 44A lets you apply in writing to the agency for money for payroll, rent and other essential costs. [f3] If it is a bank hold, it goes through the bank's own review, and you can complain through BNMLINK if the bank is slow. [f6]

How long can our startup's account stay frozen or restricted?

An AMLA section 44 freeze ends after 90 days unless you are charged, and a later seizure or Section 50 order lapses after 18 months if no one is charged. [f4] Clear company documents may help it end sooner. Ask the bank in writing how long its own review will take, and if it drags on, raise a complaint through the proper channel.

Who investigates a startup account flagged this way?

If it becomes a criminal investigation, it usually goes to CCID, PDRM's Commercial Crime Investigation Department. [f5] Giving clear company records, invoices and customer contracts early helps the investigation move and shows you are a genuine business.

What should we tell our investors while this is unresolved?

Give them a clear, factual update rather than silence. Explain what triggered the review, what you have done about it, and a realistic timeline. Saying a lawyer is handling it shows them the matter is being dealt with properly.
