When a Johor freeze stops your cash

A frozen account is frightening for any household or business in Johor. The first problem can be practical: rent, wages and instalments are still due.

The freeze laws are federal and work the same in Johor Bahru, Batu Pahat, Muar and Kluang. What differs is where you deal with police and courts, set out near the end of this page.

First, find out who froze the account

You need to know which law was used, because each one has a different way to ask for a release.

Under AMLA section 50, the Public Prosecutor can order a freeze on money suspected to come from crime. [f2]

A police officer of Sergeant rank or above can also freeze an account under Criminal Procedure Code section 116D. No court order is needed. [f4]

Your bank or the investigating officer may be able to tell you which power was used. A lawyer can confirm it from the freeze notice.

Asking for money for living costs (section 44A)

If an enforcement agency froze the account under AMLA, section 44A lets you apply to vary the freeze. You can ask for money for reasonable living or business costs. [f1]

You apply in writing to the agency, and a more senior officer decides. No court is involved, and the answer is not automatic.

A release frees only the approved amount. The rest of the account stays frozen. For how lawyers charge for this work, see the frozen account legal cost guide.

What to put in the request

The request is only as strong as its proof. Collect tenancy or loan agreements, payslips, utility bills, invoices and any other fixed monthly costs.

Ask for an amount that matches your real monthly bills, not a round number. A lawyer can prepare the written application and the supporting papers for you. See what a lawyer can do.

How long the freeze can last

A freeze by an enforcement agency under section 44 lasts up to 90 days unless a charge is brought. An order under section 50 lapses after 18 months if no one is charged (section 52A). [f3]

A police freeze under section 116D lapses after 18 months if no one is prosecuted. The freeze duration guide explains each time limit, and a lawyer can track your dates.

Johor police, courts and help with costs

A police freeze under section 116D is carried out by an officer attached to a police unit. In Johor that means the Johor Police Contingent (IPK Johor) on Jalan Tebrau in Johor Bahru, or a district headquarters (IPD) such as Muar, Batu Pahat or Kluang [f7].

Note the officer’s name, the station and the date on your freeze papers. A release request goes to the agency that froze the account, and the High Court sits at Johor Bahru and Muar if a case reaches court [f6].

If cost is a worry, the Legal Aid Department (Jabatan Bantuan Guaman) lists offices in Johor and in Muar [f8]. The Malaysian Bar also runs legal aid centres at the Ibrahim International Business District and in Muar [f9]. The Johor page covers the rest of the state.

Can I get money out of a frozen account in Johor?

Sometimes. If an enforcement agency froze the account under AMLA, section 44A lets you apply in writing to that agency to release money for reasonable living or business costs. A more senior officer decides, and the answer is not automatic. A lawyer can build the request around proof of your rent, wages, instalments or supplier bills. [f1]

What does a release request need to show?

Proof of real, regular costs. Useful papers include tenancy or loan agreements, staff payslips, utility bills, invoices and school fees. A lawyer can help you collect them and ask for an amount that matches what you actually pay each month. [f1]

Where do I take a section 44A request or a freeze notice in Johor?

A section 44A request goes in writing to the enforcement agency that froze the account, not to a court. For a police freeze, the officer is attached to IPK Johor in Johor Bahru or a district headquarters such as Muar, Batu Pahat or Kluang. Note the officer, the station and the date, and show the notice to a lawyer. [f7]

How long can the freeze last in Johor?

A freeze by an enforcement agency under section 44 lasts up to 90 days unless a charge is brought. An order under section 50 lapses after 18 months if no one is charged (section 52A). A police freeze under section 116D lapses after 18 months if no one is prosecuted. A release under section 44A only frees approved amounts; the rest of the account stays frozen. [f3]

What if I cannot afford a lawyer in Johor?

The Legal Aid Department lists offices in Johor and in Muar, and the Malaysian Bar runs legal aid centres at the Ibrahim International Business District and in Muar. Each sets its own criteria, so ask whether you qualify. Ask early, because a good release request takes time to prepare. [f8]
