Why the timeline matters

If your account is frozen and you are being investigated for a mule account offence, the first question is how long this will take. Every day without your money makes it harder to pay rent and bills and support your family.

Below are the stages of a mule account investigation in Malaysia. Every case differs and no stage has a fixed time, but knowing the order helps you plan and act at the right moments.

Stage 1: police report to IO assignment

The investigation starts when a police report is made, often by a scam victim or a bank’s compliance team. Once it is registered, the district police headquarters assigns an investigating officer (IO). How long this takes is not fixed.

Your first actions after learning about the freeze matter. Speak to a lawyer before you reply to any contact from the police.

Stage 2: your statement

The IO will call you to the police station to record your statement under Section 112 of the Criminal Procedure Code. Police can call you at any point in the investigation.

You can see a lawyer before the statement, and whether the lawyer can come into the room is up to the officer. Your lawyer can help you answer the questions you must answer, while protecting your right not to incriminate yourself. Bring your bank statements and any papers that explain the flagged transactions.

The investigating officer’s role is to gather facts. How well you cooperate now affects how quickly the IO can build the investigation paper.

Stage 3: active investigation

After the statements, the IO collects bank records, checks transaction histories, speaks to other witnesses and builds the investigation paper (IP). How long this takes depends on the case.

Simple cases, with one transaction and clear records from the account holder, finish sooner. Complex cases with several accounts, large sums or links to a syndicate take longer.

Your account may stay frozen during this time. An AMLA section 44 freeze lasts up to 90 days unless you are charged, and a later seizure order lapses after 18 months if no one is charged. Knowing how long freezes last helps you plan your money.

Stage 4: the IP goes to the DPP (varies)

When the investigation paper is complete, the IO sends it to the Deputy Public Prosecutor (DPP). [f4] The DPP decides one of three things: charge you, send the IP back for more investigation, or close the case with no further action (NFA).

The DPP’s review takes longer when there is a lot of evidence or a heavy caseload. You and your lawyer cannot attend it, but well-organised evidence sent through the IO may be considered. If you cooperated fully when the police contacted you, that record can help.

Stage 5: the outcome

No one can say in advance how long the whole process will take. Cases that go to court take longer.

If you are charged, the court process adds its own time, and an appeal adds more.

What speeds up your investigation

Give the IO every document they ask for without delay, and attend every appointment on time. Get a lawyer experienced in frozen account cases early, so what you send the IO and DPP is organised from the start.

Clear proof of your income and of the reason for the flagged transactions can help the IO finish the IP. The account freeze overview explains which documents matter most.

What slows down your investigation

Slow or incomplete replies to the IO’s requests add time. Cases with several bank accounts, several suspects or overseas transfers need more coordination and take longer.

Heavy caseloads can also cause delays. If your case seems stuck, your lawyer can write to the IO’s superior officer or the DPP’s office to ask for an update.

Managing your money during the investigation

Your account may stay frozen for some time, so plan ahead. If you need money for rent, food or medical costs, and an enforcement agency froze the account under AMLA section 44, you can apply in writing to that agency under Section 44A to vary the freeze order. Your lawyer can prepare this application.

Keep records of all costs and hardship the freeze causes, because they support any application to vary the order. Do not use anyone else’s account to receive or hold your money.

When to follow up

If you have heard nothing from the police and are worried, ask your lawyer to follow up. If a long time passes with no news on the IP, your lawyer can ask for a written update.

Keep a log of every contact, every document you send and every follow-up. If the process becomes unreasonably slow, this log can support any application to lift the freeze.

A short WhatsApp message describing your situation is enough for a lawyer to tell you which stage you are at and what to expect next.

How long does a mule account investigation take in Malaysia?

There is no fixed time. It depends on the case, and cases with several accounts or overseas transfers usually need more coordination. Your lawyer can ask the investigating officer for an update.

When will the investigating officer contact me?

There is no fixed time. An investigating officer (IO) is assigned once a police report is registered, and police can call you for a statement at any point. If you hear nothing and are worried, your lawyer can follow up with the district police headquarters.

How long does the DPP take to decide on charges?

After the IO hands in the investigation paper, the Deputy Public Prosecutor decides. The time varies with the amount of evidence and the DPP's caseload. The DPP may charge you, ask for more investigation, or close the case with no further action.

Can I check the status of my investigation?

Yes. You or your lawyer can ask the investigating officer for an update. If replies are slow, your lawyer can write to the IO's superior officer or the DPP's office. Keep a record of every follow-up in case the delay becomes unreasonable.

What happens if the investigation drags on?

The investigation itself has no fixed deadline. An AMLA section 44 freeze lasts up to 90 days unless you are charged, and a later seizure order lapses after 18 months if you are not charged. If things stall, your lawyer can write to the authority that froze the account, or apply in writing under section 44A to vary a section 44 freeze.

Does cooperating make the investigation faster?

It can help. Sending documents quickly, turning up on time and replying through the proper channels let the IO finish the investigation paper sooner. Slow replies add time.
