What is a compliance hold?

A compliance hold is a temporary block a bank puts on your account, or on some transactions, while it reviews the activity for legal or regulatory concerns. It is meant as a pause, not a final decision. The bank checks whether the money, or how the account is used, raises a problem.

A hold can start for many reasons, such as an unusual incoming transfer, a match on a watch list, or a report from someone else. During the review, some or all of your access may be paused.

How is a hold different from a restriction or a termination?

These are three different bank actions. A compliance hold is a temporary pause while a review runs. A restriction limits some features, such as transfers out, and a termination closes the account.

A hold is the lightest of the three. It can come before a decision: lifting the hold, moving to a restriction, or, in serious cases, closing the account. A hold can also sit alongside a police freeze, where a police officer of Sergeant rank or above blocks transactions immediately under the CPC amendment. [f1]

What should I do while a hold is in place?

Ask the bank in writing for the reason and the expected timeframe. Keep every reference number and reply. If the funds are tied to a criminal investigation, a formal AMLA freeze under section 44 ends after 90 days if you are not charged, and a seizure order lapses after 18 months if no charge is brought. [f2]

If the bank gives no clear answer, you can escalate through its official complaints channel, BNMLINK on 1-300-88-5465. [f3] If the hold connects to a suspected mule case, a lawyer can identify the legal basis and explain your options.

Is a compliance hold the same as a frozen account?

They overlap but are not the same. A compliance hold is the bank's own temporary pause while it reviews activity. A frozen account comes from an order by police or another enforcement authority. A hold can turn into a formal freeze, or be lifted once the bank finishes its check.

How long can a compliance hold last?

There is no single fixed period for a bank's internal review, so ask the bank in writing how long it expects to take. A freeze under AMLA section 44 ends after 90 days if you are not charged. An AMLA seizure order lapses after 18 months if you are not charged.

What can I do if the hold does not lift?

First ask the bank in writing for the reason and how long it expects to take. If you get no clear answer, you can escalate through BNMLINK on 1-300-88-5465. If the money is caught in a criminal investigation, a lawyer can find the legal basis and advise your next step.
